NUISANCE PROPERTY ABATEMENTS

A nuisance property creates a negative impact on the quality of life for those living nearby.

Problems that can be considered a nuisance include: 
  • Noise
  • Drug Activity
  • Prostitution
  • Fighting
  • Drunkenness 
  • Squatters
  • Trash Accumulation
  • Building Dilapidation

Normally, a call to police can solve these issues, but with a nuisance property a more permanent fix is necessary. State law and local ordinances allow for relief in a variety of ways. Building codes, fire codes and zoning codes can be used to clean up properties and make them safer.

The DA can also file a Petition for Nuisance Abatement by presenting a judge with proof of ongoing criminal activity at a business or house.  The judge will order the owner to appear in court to answer the petition and may allow law enforcement to padlock the property until the owner takes specific steps to alleviate the nuisance activities.  

Nuisance actions are designed to provide direct and immediate relief to neighborhoods impacted by crime. They are an effective tool to clean up problem properties and make neighborhoods safer.
